Update: The Wisconsin Department of Justice gave new details in a news release Friday about what led to two Eau Claire police officers shooting a gunman over the weekend.

According to a press release, police were called to the Declaration Drive home on Sunday evening due to a call that he had pointed a gun at his neighbors’ house.

When officers arrived they learned of a “direct threat which led them to confront the subject”.

The suspect has been identified by the DOJ as 34-year-old Clayton T. Livingston.

The press release goes on to say that when they confronted Livingston and told him to drop his gun, he pointed it at police officers. Officer Sam Sperry and Officer Tre Johnson both shot Livingston and punched him. Officials said lifesaving measures were then taken and he was taken to a local hospital.

The incident was recorded on a police body camera, according to the DOJ, adding that per protocol, both officers are on administrative leave.

CLEAR WATER (WQOW) – As per protocol, DCI is investigating after an Eau Claire police officer shot a man during a domestic disturbance call Sunday night.

According to a Wisconsin DOJ news release, police responded to a domestic disturbance call around 11:40 p.m. Sunday evening in the 1900 block of Declaration Dr.

Upon arrival, officers confronted an armed man. The officers fired their weapons and hit him. He was taken to hospital and his condition is stable. No officers were injured.

The entire incident was captured on body camera footage.

In accordance with departmental policy, the officers concerned have been placed on administrative leave. Their names have not been disclosed. According to Eau Claire Police Chief Matt Rokus, one is a five-year veteran of the force, the other is a two-year veteran.

DCI is investigating the incident, with assistance from Crime Victim Services, Wisconsin State Patrol and the Eau Claire County Sheriff’s Office. They will review the evidence in the case and turn the reports over to the Eau Claire County prosecutor when complete.
